By downloading, installing, or using the Beach Finder mobile application or website (collectively, the "Service"), you confirm that you are at least 13 years of age and agree to be bound by these Terms and Conditions and our Privacy Policy.
If you do not agree to these Terms, you must not use the Service. We reserve the right to update these Terms at any time; continued use of the Service after changes are posted constitutes your acceptance of the new Terms.
2. About the Service
Beach Finder is a beach discovery platform that provides information about beaches worldwide, including descriptions, photos, weather data, sea temperatures, coordinates, and related travel content. The Service is operated by Smart Coding S.R.L.
We grant you a revocable, non-exclusive, non-transferable, limited licence to use the Service strictly for personal, non-commercial purposes in accordance with these Terms.
3. Accuracy of Information
We strive to keep beach information accurate and up to date, but we make no warranties — express or implied — that any content including beach descriptions, temperatures, water quality, coordinates, photos, access details, or ratings is accurate, complete, or current.
Beach conditions can change rapidly due to weather, tides, environmental events, closures, or local regulations. Always verify conditions locally before visiting any beach, particularly for remote or hazardous locations.
Beach Finder is not a safety application and must not be relied upon for emergency decisions. Smart Coding S.R.L. is not liable for any loss, injury, or inconvenience arising from reliance on information provided through the Service.
4. Weather & Sea Data
Live weather and sea temperature data is sourced from Open-Meteo and is provided for informational purposes only. Actual conditions at any beach may differ materially from the data shown due to local microclimates, data latency, or service outages.
Do not rely solely on our weather data for safety decisions. In particular, do not use this app to assess conditions for swimming, surfing, or other water activities where inaccurate data could pose a risk.
5. Intellectual Property
All content in the Service — including beach descriptions, data compilations, search functionality, the Beach Finder name, logo, and design — is owned by or licensed to Smart Coding S.R.L. and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any part of the Service without our prior written permission.
Beach photographs are sourced from Unsplash and are subject to the Unsplash License. Map data is provided by OpenStreetMap contributors under the Open Database Licence.
6. Acceptable Use
You may use Beach Finder to discover beaches, save favourites, and access travel information for personal purposes. You agree not to:
- •Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
- •Attempt to reverse-engineer, decompile, disassemble, or extract source code from the app.
- •Scrape, crawl, or use automated means (bots, spiders, scripts) to access or index the Service's data without our prior written consent.
- •Interfere with or disrupt the operation of the Service, its servers, or networks.
- •Use the Service or its data to develop a competing product or service.
- •Attempt to gain unauthorised access to any part of the Service or its infrastructure.
- •Transmit malware, viruses, or any other harmful code through or in connection with the Service.
- •Use the Service for commercial purposes without our express written permission.
Violation of these restrictions may result in immediate termination of your access and, where applicable, legal action.
7. Third-Party Services & Links
Beach Finder integrates with third-party services including Open-Meteo (weather), OpenStreetMap/Nominatim (maps and geocoding), Unsplash (photos), and Expo/EAS (build and delivery infrastructure). These services are provided on an "as-is" basis by their respective operators. Smart Coding S.R.L. is not responsible for the accuracy, availability, or data practices of any third-party service.
The Service may also display links to external websites such as accommodation or activity providers. We are not responsible for the content, privacy practices, or availability of any linked site. Accessing third-party sites is at your own risk and subject to their terms.
8. User Accounts
If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately at [email protected] if you suspect unauthorised access.
We reserve the right to suspend or terminate accounts that violate these Terms, engage in abusive behaviour, or whose continued use poses a risk to the Service or other users.
9. Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Smart Coding S.R.L. disclaims all warranties, express or implied, including but not limited to:

- •That the Service will be uninterrupted, error-free, or free from viruses or other harmful components.
- •That beach information, weather data, photos, or maps are accurate, complete, or current.
- •That any defects in the Service will be corrected.
10. Limitation of Liability
To the maximum extent permitted by applicable law, Smart Coding S.R.L., its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- •Loss of profits, revenue, data, business, or goodwill.
- •Business interruption or loss of opportunity.
- •Personal injury or property damage arising from your use of the Service or any beach visited as a result of information found in the Service.
- •Errors or inaccuracies in third-party data (weather, maps, or photos).
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above may not apply to you. Nothing in these Terms limits liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.
11. Indemnification
You agree to indemnify, defend, and hold harmless Smart Coding S.R.L. and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or relating to your use of the Service, your violation of these Terms, or your infringement of any third-party rights.
12. App Store & Platform Terms
Beach Finder is distributed through the Apple App Store and Google Play Store. Your download and use of the app is also subject to the applicable platform's terms of service. In the event of any conflict between these Terms and the platform's terms, the platform's terms will prevail for matters relating to your account, payments, and app distribution.
13. Changes to the Service
We reserve the right to modify, suspend, or discontinue the Service or any part of it at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service. We may also introduce new features, impose usage limits, or restrict access to parts of the Service at our discretion.
14. Severability & Entire Agreement
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
These Terms and our Privacy Policy constitute the entire agreement between you and Smart Coding S.R.L. regarding the Service, and supersede all prior agreements or understandings on the same subject matter.
15. Governing Law
These Terms are governed by and construed in accordance with applicable law. For users in the European Union, nothing in these Terms affects your rights under mandatory local consumer protection laws, which cannot be waived by contract.
